Quick answer: A cap-gap extension automatically keeps an F-1 student in status, and keeps OPT work authorization alive, after the OPT card expires while a cap-subject H-1B change-of-status petition is pending or approved. Since a DHS rule took effect on January 17, 2025, it lasts until April 1 of the H-1B fiscal year (not October 1 as before), or until the approved H-1B start date if that comes first (Study in the States, April 28, 2025). For FY 2027 petitions, that means work authorization through March 31, 2027. It ends early if the petition is denied, withdrawn, rejected or revoked, or if you leave the US while the change of status is pending.
This guide is for F-1 graduates whose employer filed an H-1B petition this year, people whose petition is still pending after October 1, and anyone on OPT trying to work out whether cap-gap can protect them. If you are still counting days without a job, read our guide to OPT unemployment days first, because cap-gap does not reset that clock. This is general information, not legal advice. Your DSO and your employer's immigration attorney have the final word on your case.
What is a cap-gap extension?
"Cap-gap" is the stretch of time between the end of your F-1 status or OPT and the start of your H-1B status. It exists because of the calendar. Employers can't file a cap-subject H-1B petition more than six months before the start date, so the earliest filing date is April 1 and the earliest start date is October 1, the first day of the federal fiscal year (USCIS). Most May graduates see their 12-month OPT end in late spring or summer, months before an October H-1B start.
The cap-gap rule fills that hole. It is automatic: you don't file anything and you don't get a new EAD card. USCIS says the only proof currently available is an updated Form I-20 from your DSO showing the extension, and that the updated I-20 is proof, not a requirement, for you to keep working (USCIS).
There are two kinds of cap-gap extension, and the difference matters:
| Your situation when USCIS received the petition | What cap-gap gives you | Source |
|---|---|---|
| On valid post-completion OPT or STEM OPT | F-1 status and permission to keep working | USCIS M-274, 7.4.2 |
| In the 60-day grace period after OPT ended | F-1 status only. No work until H-1B status starts | USCIS |
| Still in your degree program | F-1 status. Work only under your existing on-campus or CPT rules | USCIS M-274, 7.4.2 |
The new rule: cap-gap now runs to April 1, not October 1
Until January 2025, cap-gap ended on October 1. If USCIS hadn't approved your petition by then, your OPT-based work authorization stopped even though the petition was still pending. The modernization rule published in December 2024 (Federal Register) moved the end date to April 1 of the fiscal year. Study in the States says it applies to students with timely filed cap petitions starting with the FY 2026 registration period (Study in the States).
What this means today:
- FY 2027 petitions (filed from April 1, 2026 with an October 1, 2026 or later start): cap-gap can last until April 1, 2027. On Form I-9, employers enter "CAP-GAP" and March 31 of the fiscal year as the expiration date, then reverify by March 31 (USCIS M-274).
- If USCIS approves your petition, H-1B status begins on the validity start date of the approval, and cap-gap ends then, whichever comes first (USCIS).
- Watch out for old pages. Some university and blog pages still say cap-gap ends September 30 or October 1. Check the "last updated" date on anything you read. The USCIS cap-gap page was last reviewed January 17, 2025, and reflects the April 1 rule.
Who qualifies for a cap-gap extension?
You qualify if all of these are true (Study in the States; USCIS):
- Your registration was selected in the H-1B lottery, and your employer then filed the full petition. A registration alone does not start cap-gap.
- The employer is cap-subject. Cap-exempt employers, such as universities and nonprofit research organizations, can file at any time, so their petitions don't get cap-gap.
- The petition asks for a change of status inside the US, not consular processing.
- It was filed during the filing period while you were still in F-1 status (in school, on OPT, or in the 60-day grace period).
- It requests a start date in the fiscal year being applied for.
- You haven't violated your F-1 status.
Situations where cap-gap does not apply
| Situation | Why it fails | What to do |
|---|---|---|
| Registered but not selected | No petition was filed | Plan around your OPT or STEM OPT dates and next year's registration |
| Employer chose consular processing | Cap-gap covers only change-of-status requests | Expect to leave and get an H-1B visa abroad before starting |
| Cap-exempt employer | Those employers can file year-round | Time the petition so your OPT doesn't run out first. See cap-exempt H-1B employers |
| Petition received after your grace period ended | You were no longer in F-1 status | Talk to an immigration attorney right away |
| Petition received after the EAD expired, during grace | You get status only, not work | Don't work until H-1B status starts |
The FY 2027 picture
The odds of being in cap-gap at all shrank this year. USCIS used a weighted lottery for the first time for FY 2027. Registrations at wage level IV were entered four times and level I once (USCIS H-1B Cap Season). About 211,600 registrations were properly submitted, down roughly 38% from 343,981 the year before. USCIS said on July 17, 2026 that it had enough petitions to fill the 85,000 cap, so there was no second lottery (Ellis, July 17, 2026).
So if you weren't selected in March 2026, cap-gap is not an option for this fiscal year. If you were selected and your petition is still pending today, the April 1, 2027 end date is your real deadline.
What about the $100,000 H-1B payment?
USCIS says the September 2025 proclamation doesn't apply to a petition requesting a change of status for someone inside the US when that change of status is granted. It does apply if USCIS finds the person ineligible for the change of status, for example because they departed the US before it was decided. On June 8, 2026, a federal court in Massachusetts vacated the agency guidance that implemented the payment. The First Circuit denied the government's request for a stay on July 24, and DHS says it is complying while it considers next steps (USCIS H-1B Specialty Occupations). For cap-gap students, the practical lesson is the same either way: don't travel while your change of status is pending.
What ends a cap-gap extension early
| Event | What happens | Source |
|---|---|---|
| Petition denied, rejected, revoked or withdrawn | Cap-gap ends. You get a 60-day grace period from the notice to leave or change status | USCIS |
| Denial for status violation, fraud or misrepresentation | No grace period. You must leave immediately | USCIS (same page) |
| Approved for consular processing instead of change of status | Cap-gap ends even though the petition is approved | USCIS (same page) |
| You travel abroad while the change of status is pending | The change of status request is treated as abandoned | USCIS (same page) |
| Your OPT unemployment days run out | OPT can be terminated. The 90 or 150-day limit still applies during cap-gap | University of Utah ISSS |
| April 1 arrives with the petition still pending | Cap-gap ends. Talk to counsel about your status and work options | University at Buffalo ISS |
Can I travel during cap-gap?
Only after approval. USCIS says you can generally travel and come back in F-1 status if the H-1B petition and change of status are approved, you return before the H-1B start date, and you are otherwise admissible. Leaving while the change of status is pending abandons it (USCIS). A CBP officer still makes the final call at the border. For most people whose FY 2027 petition is pending now, that means no December trip home unless counsel clears it in writing.
If your H-1B is still pending after October 1
This is the biggest group searching "cap gap extension" right now. Here is a checklist:
- Get the updated I-20. Send your DSO the I-797C receipt notice. Some schools ask you to wait about two weeks after the receipt so SEVIS can update first (Northeastern OGS).
- Make sure HR has the I-9 right. The M-274 tells employers to record your expired EAD plus the I-797C as a valid List A document, write "CAP-GAP" and March 31, 2027, and reverify by that date (USCIS M-274). If payroll flags you on October 1 while your petition is pending, show HR that section.
- Ask about premium processing. USCIS says premium processing is available for all H-1B petitions (USCIS), with action promised within 15 business days for Form I-129 (USCIS premium processing). Your employer decides whether to pay for it.
- Answer any RFE fast. A request for evidence pauses the decision, not your cap-gap, but the April 1 date doesn't move. Send your attorney transcripts, degree and past I-20s the same day they ask.
- Stay in the country. See the travel rules above.
- Keep working for the petitioning employer. Cap-gap hangs on that petition. If the job ends, the petition is usually withdrawn, and withdrawal ends cap-gap.
- Track the date. Put March 31, 2027 on your calendar with reminders at 60 and 30 days, and check in with counsel if nothing has happened by February.
